What can I do about a scam payday loan company who continues to harass me to no end?
Question by Ron: What can I do about a scam payday loan company who continues to harass me to no end?
The company is called Usa Cash Advance the people there state to customers that they gave “loans” to people and they harass them to pay back the money, or they will put them in jail or prison etc. This has happened to many people including a close family friend of mine. They don’t seem to give up.

If your friend has an outstanding loan, they will keep calling him until he pays it back. Its easy – you want the calls to stop, then pay off your debt
If he hasnt’ taken out a loan then he can call the police and report an extortion attempt
BUT before he does that he should run a credit report. A friend was getting calls about a loan that she assumed was a scam until her dad told her to run a credit report. Turns out she was the victim of identity theft and someone had not only taken out a loan in her name, they had also opened and maxed out two department store credit cards in another state
Give your answer to this question below!
You go to your local police station and report the issue in person. Explain what is going on and ask a detective for advice.
I would tell the company that calls to mail you stuff in writing and to stop calling you. By law I think they must stop calling if you ask them to send via mail instead. I would then report them to your state’s attorney general’s office(search online) for more assistance.
It is illegal for them to threaten prison or to act as though they are law enforcement. Your friend may be able to sue them for harassment if he has voicemail recordings of their messages.
If he did borrow money from them he would need to pay it back or they may seek to get a judgment to garnish his wages for the amount. When I did HR, we had a guy who always took out payday loans and didn’t pay them back and his check would be garnished for the amount due. If your friend feels he does not owe them money, he should send them a letter by certified mail demanding written proof of debt ownership and also send them a letter demanding that they cease all phone contact and only communicate in writing. Even with that, it is likely this company will not stop. These types of collectors are notorious for harassing people. Your friend should keep a log of their calls (when they called, who he talked to) and if they keep after him he may have a good case for harassment.
Also, you may be interested in looking at some complaints about USA Cash Advance people have registered. this can be found at http://www.complaintsboard.com/complaints/us-cash-advance-c246245.html If that doesn’t work, just google USA Cash Advance or USA Cash Advance Scam
to add to the original post, there is quite a large scam going on where collectors call pretending to be with USA Cash Advance collecting on a payday loan on people who have never taken such a loan out. They pretend to be police officers, attorneys, work for bogus law enforcement agencies. They demand payments for bogus loans and threaten people with lawsuits, prosecution and arrests. They refuse to give you any of their information and refuse to discuss any specifics of the “debt”, they just demand payment. They call again and again, harassing people. USA Cash Advance is aware of this scam and has even posted a scam warning on their website. If the person calling you has a middle-eastern accent and pretends to be an attorney or law enforcement, they are a part of this scam. It has nothing whatsoever to do with USA Cash Advance, so even if your friend did have an unpaid debt with USA Cash Advance, he should not give these scam artists any money, because they are not USA Cash Advance and do not represent them in any way!!!
Did you or these friends ever apply for a payday loan online? That is who these people are.
They can’t put you in jail, but if you did take a payday loan, they can call you for payment. It is actually illegal for them to claim they are going to either put you in jail or sue you and not follow through.

Tell him to ignore the phone calls, especially if the callers are foreign. These people aren’t legitimate. Once, my husband and I were drinking, and decided to mess with the guy. He tried to have phone sex with me, and called right back for the same thing after I cracked up and hung up on him.
As for sending a certified letter, good luck with that. They are overseas, and since they change the number that they are calling from every few weeks, I don’t imagine you’ll be able to get a decent address out of them.
I got a call out of the blue from them the other day on the way home from work. Luckily, I have a whistle in my purse. I don’t think he knew what hit him. I’m contemplating the purchase of an air horn. LOL
If this is really their debt, then they need to negotiate a settlement…get all terms in writing first. More info at – http://catdadsblog.wordpress.com/how-to-pay-collection-accounts-on-your-credit-report/
If this is not their debt…or they’re engaging in illegal tactics: Send/fax the collection agency a letter via Certified Mail + Return Receipt (do NOT use regular mail) stating:
Per the Fair Debt Collection Practices Act, cease all communications with me. Receipt of this letter is officially being time stamped via Certified Mail.

To speed things up, fax this same letter to the collection agency. Free fax service at: http://www.myfax.com/free/
If they keep calling, read the following statement to them:
– Be advised that this call is being recorded. If you do not consent to being recorded, you need to terminate this call. Continuation of this phone call after officially being informed that it is being recorded implies consent to be recorded. This recording will be used to pursue Fair Debt Collection Practice Act violations in a court of law.
